1. Acceptance of Terms
By downloading, installing, or using BreakMode ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and BreakMode ("we," "us," or "our").
2. Description of Service
BreakMode is a wellness application that:
- Integrates with your calendar (Google Calendar or iOS Calendar)
- Analyzes your schedule to recommend optimal break times
- Automatically schedules break events in your calendar
- Sends notifications to remind you to take breaks
- Tracks your break-taking habits and progress
The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.
3. User Accounts and Access
3.1 Account Creation
You do not need to create an account to use BreakMode. However, you must:
- Be at least 18 years old
- Have a valid calendar account (Google or iOS)
- Have permission to connect your calendar to third-party apps
3.2 Calendar Permissions
By connecting your calendar, you grant BreakMode permission to:
- Read your calendar events
- Create break events in your calendar
- Modify or delete break events created by BreakMode
You can revoke these permissions at any time through your calendar provider's settings or by disconnecting the calendar in BreakMode Settings.
4. Acceptable Use
4.1 Permitted Use
You may use BreakMode for personal, non-commercial wellness purposes.
4.2 Prohibited Use
You agree NOT to:
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any portion of the App
- Use automated scripts or bots to interact with the App
- Resell, redistribute, or sublicense the App
- Remove or alter any copyright, trademark, or proprietary notices
5. Intellectual Property
5.1 Our Property
BreakMode, including all source code, design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.
5.2 Your Data
You retain all rights to your calendar data and preferences. We claim no ownership over your personal information.
5.3 Feedback
If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, worldwide license to use, modify, and incorporate such feedback without compensation.
6. Calendar Integration
6.1 Third-Party Services
BreakMode integrates with Google Calendar and iOS Calendar, which are third-party services. Your use of these services is subject to their respective terms:

- iOS Calendar: Apple Terms of Service
6.2 Calendar Accuracy
We strive to accurately schedule breaks, but we are not responsible for:
- Conflicts caused by simultaneous calendar modifications
- Break events that overlap with last-minute meetings
- Calendar sync delays from third-party providers
- Data loss due to calendar provider issues
7. Subscription and Payment
7.1 Free Version
BreakMode is currently offered free of charge. We reserve the right to introduce paid features or subscriptions in the future.
7.2 Future Paid Features
If we introduce paid features:
- You will be notified in advance
- Existing features will remain free or you'll have a grace period
- All payments will be processed through the Apple App Store
- Refunds will follow Apple's refund policy
8. Disclaimers and Limitations of Liability
8.1 No Medical Advice
BreakMode is a wellness tool, not a medical device. The App does not provide medical advice, diagnosis, or treatment. Consult a healthcare professional for medical concerns.
8.2 "As Is" Service
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of results
8.3 Limitation of Liability
To the maximum extent permitted by law, BreakMode shall not be liable for any:
- Indirect, incidental, special, or consequential damages
- Lost profits, data, or business opportunities
- Damages resulting from calendar errors or sync issues
- Third-party calendar provider failures
Our total liability shall not exceed $50 USD or the amount you paid us (if any) in the last 12 months.
9. Indemnification
You agree to indemnify and hold BreakMode harmless from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any misuse of your calendar integration
10. Termination
10.1 Your Right to Terminate
You may stop using the App at any time by disconnecting your calendar in Settings and deleting the App from your device.
10.2 Our Right to Terminate
We may suspend or terminate your access if you violate these Terms, engage in fraudulent or illegal activity, or abuse or misuse the App.
10.3 Effect of Termination
Upon termination, your right to use the App immediately ceases. Break events in your calendar will remain (you can delete them manually). Local preferences data will be deleted when you uninstall the App.
11. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via in-app notification and an updated "Last Modified" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or the App shall be resolved through good-faith negotiation first (contact us at [email protected]), then binding arbitration if negotiation fails. You agree to waive your right to a jury trial or class action lawsuit.
13. Miscellaneous
These Terms, along with our Privacy Policy, constitute the entire agreement. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not constitute a waiver.
